A team of lawyers under the aegis of the Movement for the Abolition of the Rank of the Senior Advocates of Nigeria, has filed a motion before a Federal High Court in Lagos to stop the swearing–in of 30 newly appointed Senior Advocate of Nigeria(SAN).
The suit was instituted by the chairman of the movement, Pa Tunji Gomez and four other lawyers, namely: Foluso Fayokun, Seth Amaefule, Peter Okoye and Chief E.A Otokhina.
In the suit, the plaintiffs (Gomez and others) are praying the court to bar the Chief Justice of Nigeria, Justice Katsina-Alu, the President of the Nigerian Bar Association, Joseph Daudu and the Attorney-General of the Federation and Minister of Justice, Mohammed Bello Adoke(SAN), from taking any further steps pursuant to the swearing-in of the 30 newly announced Senior Advocates of Nigeria.
Other respondents in the suit are the Legal Practitioners Privileges Committee, the Secretary General of the NBA, Mr Olumuyiwa Akinboro and the Registered Trustees of the Nigerian Bar Association.
In the application dated July10, the applicants contended that since there were three pending suits on the issue of abolition of the rank of SAN, any further action by the respondents, who had already announced the names of the new SANs, would foist a fait accompli on the court saying that the action would amount to contempt of court.
The applicants further argued that since no lawyer applied for SAN in 2011 and yet some lawyers were awarded the rank for 2011 though they did not apply, there was no justification to award the rank of SAN to the purported awardees for 2011 who never applied for it.
